THE BLACK PANTHER
PRISONER IS INJECTED FORCE
Eldndge Cleaver made the decison to politically exile hinelf
November 27th, on the basis thut the Adalt Authority made an auth deci-
ny and that he has been denied his constitetionsl nght to dne proces of
rod
‘The revocation of Cleaver’s parole we= ilegal, because ao parole
violation war committed.
The Adult Authority parole board has tied to maintain that Clerver
violated his parole by having a rifle in his posurasina, und by associating
with individuals of bad reputetion. This contention, we will show, is false
The Adult Authority version comtradicts the Superior Court order itself
“., . Cleaver’s only handling of a freann (the rifle) was in obedience
to a police command, He did not handle a hand gun at all, There was noth-
ing one way or the other to show a conspiracy or a situation calling for the
ae of the doctrine of aiding and abetting Hence, nothing support
either the possession of a fireacn or the ascault charge.
- As to the charge of amociation with individoals of bad reputation, the
report indicated that two or three of those named had "police records,” bat
nothing to show whether any had been convicted of anything, or whether
Cleaver knew of their arrest record.” (Sepenior Court et HIT, 195, 140,
Mi.
Parole Cleaver «ae denied due process of law by lncing denied
epportunity to preernt his case.
Why was Cleaver returmed to prison as a parole vielator if document
ed evidence to the contrary had been prevented in his defense? To answer
that question, one must examine the Adult Authority. This beard has the
Tight to arbitrarily revoke or suspond parole ow any individual. At the same
time, the Adult Authority maintains—falcely—that Cleaver has the opper
tunity to defend himself at a bearing. This is how it works
“A parolee is vdrved with violation charges, is tnterviewod, i given a
hearing (before the Adult Authority tyelf, the chargieut purty) at which the
parolee may “plead” to the parole violation charges, and i» afforded an op-
portunity to present his defense.”
“At the “hearing” a parolee ts adleniod the right to counsel, may not
have an independent and impartial officer to conduet the bearing and make
decision.” (Petition for Hearing in the Supreme Court, p17)
Not only does the Adult Authority hold secret bearings, but it also
tefises to notify persons wader its jurisdiction of its proceduses, or of its
variable definitions of what constitutes a le violation. This secrecy and
vageeness is in direct violation af federal law which requires agencies to
publish their procedures “for guidance of the public”
“Petitioner (Cleaver) is imeoediately and seriously
