The pigs prob- bly hoped he would catch pneumonia and fe after they failed to beat him to death, After a Black pig judge (Grousa- 1) refused a court order that would permit Doctor Fink (a leading research nero-surgeon) to see Randy. a pig doctor made a quick isit to Randy's cell on Monday tad pre- scribed penicillin every six hours and some eye ointmem, Randy received no medicine until Tuesday. The pigs attempted to interview ~ FfRaaty anyway, OUNTER-ATTACK THE MOST CRUCIAL QUESTION FACING BLACK PEOPLE TODAY IS TO BE OR n Watts, in 1965, a man, Leonard Dead- wyler, was driving his pregnant wife, who was in labor, to the hospital, He was naturally anxious to see her deliver their childwith as much ease and care as possible, Leon- ard Deadwyler drove with all speed to see that his wife got to a hospital where she could be cared for, Leonard Deadwyler was killed for having felt and acted upon the natural urgency of any human being to care for another, especially those close to him, He was shot down by Los Angeles fascist pigs because he disobeyed some traffic laws, He was shot down by racist dogs because he was a Black man, The pig who shot him was said to have committed justifiable homicide, In the 1950’s 15 year old Emmett Till was going to the store in Mississippi to purchase something, He had come to Mississippi from Illinois to visit his family, And he was glad to be there with them, He was responding in a natural way to those feelings, Possibly he walked to the store idly wistling, A White woman Claimed thathe wistled at her, Emmett Till was killed becaused a White woman said that, Emmett was lynched, burned, shot, tied to chains and dropped into a river, Emmett Till was murdered by mad, vicious racists because he was just another nigger, No one ever paid the price for Emmett Till’s life, In the 1930’s nine young Black men in Alabama were accused of raping a White woman--the Scottsboro case, Eight of them were lynched before this woman admitted they had done nothing to her, Everyone agreed it was a terrible mistake, No one even went to trial for the deaths of those eight young brothers, In 1968, a young brother, a member of the Black Panther Party, 17 year old Bobby Hutton, was on his way to help prepare food for a bar-be-que for the people, He was riding in a car with Eldridge Cleaver, the car stopped and suddenly they were surrounded by fascist Oakland pigs, After a battle that lasted over an hour, Bobby and Eldridge came out of the house they had ran into for protection from this attack, They came out hands in the air, without weapons, Bobby Hutton was blasted by pig shotguns over 17 times and his hands still in the air when the first blast hit, It didn’t take muchtimeto kill Lil’ Bobby. However alongside the genocidal war against the Viet- namese, the American ruling class has been intensifying its longest war against Black people, This war has been Jess visible. Its borders are within the Imperialist heart- land, and the total arsenal of wea- pons that the ruling class has at its disposal to keep the White peo- ple down has been reduced vis a vis Black people, as with all col- onized people of color, to one wea- pon: the GUN Against Black peo- ple, it is the Gun alone which pre- vents Black people from their lib- eration It is only within this context that the revolutionary development of the Black Panther Party and Its Savage repression by the ruling class is comprehensible. Garry, At the courthouse we met the Area Capt, of New Haven, Doug Miranda. We all proceeded to walk up the stairs to the courthouse door, where we were greeted by New Haven's finest pork chops, the New Haven State Pig Dept., who made an attempt to refuse the Chief of Staff, David Hilliard, Doug Miranda, Jean Genet and myself entry into their courthouse, by sticking big axhandles in front of our path, at the same time they were oinking in our faces, asking us what business did we have to attend to inside their pig pen. Never breaking our pace, we walk- ed through the barricade of flesh- hungry pigs, with axhandles and guns in their hands, stating that we had an appointment with our aliorney, Charles R, Garry. We walked down the hallway about 50 feet to the courtroom door, where we were greeted once again by oinking pigs with ax- handles and guns in their hands. Never breaking our pace once 1 DAVID HILLIARD CHIEF-OF-STAFF MINISTER OF CULTURE again we walked through the oink- ing pigs into the courtroom, where our attorney Charles R Garry was. Inside the courtroom there were 15 removable chairs for spec- tators-half of those were being oc- cupied by pigs trying to pass off as people-but you can always tell a pig by the slobber running down his big ugly jibbs at the of a revolutionary, There were 4 Black students in the court- room who gave up their seats, knowing that me, David and Genet were only going to ve in New Haven for a couple of days - we thought. We sat down to observe the racist court proceedings, Five minutes later, the pigs asked all of the spectators to leave the court- room, because they forgot to search me, David, Genet and Doug before entering the courtroom, They told us that they wanted tobe sure that we didn't have any dan- gerous weapons or explosives in our possession, Only seven peo- ple out of 15 spectators were asked to leave the courtroom, while 8 pigs stayed seated in the spec- tators’ chairs, olnking at the peo- ple. We re-entered the courtroom, sat down and observed the court- room proceedings of the DA., who was playing the role of Georgie-boy Wallace to the big business judge, who oilnked from behind home plate. At this time Doug Miranda had to leave for Boston for a speak- ing engagement. So me, David, and Genet sat for about an hour, watching the fascist court pro- ceedings, to see who would winthe blue ribbon as the prize pig-the D.A, or the judge, both of whom were olnking one thousand, A big stone-age pig, who looked as ifhis role was that of the clean-up pig, came and stood next to David's seat, withhis big nose pointed down at a letter that David and I were reading. We didn’t know that this pig was there until we had just about finished reading the letter: this pig began to slobber at the mouth and onto the letter that David was holding in his hand. At this time we looked up, and David asked this pig what was he reading our material for, All this pig could say, out of embarass- ment from being caught dirty, was oink, oink, oink David stood up to protect himself before the pig could attack him. Our troops have become and continue to be decimated, the jails are overflowing with our com- rades, the semi-faithful have van- ished into the pseudo-security of bourgeoisie niggerism and psyche- delic, vibrating drugs. While out of the shadows of the pre-dawn hours come highly trained, disciplined, efficient, well-equipped, profes- sional teams of mad racists from the infamous Los Angeles Police Department, Thelr names sound efficient and Secret, These crazed, creeping, brainwashed, automatic, cloak and dagger goons go under names such as SWAT, SIS, CCS, TAC, AND METRO Backed up by their net- work of spies, undercover pigs, and jJelly-spined informers, thelr pro- fessionalism cannot be questioned, but their efficiency is due only to the amateurish nature of the peo- ple’s forces. The very things of which we have warned each other for years are now reality, It is no longer speculation when one hears of a brother's door being kicked down by glassy-eyed ghouls with automatic weapons--that they love to use--in the wee hours of the morning. No longer is it mere- ly romantic imagination when a brother says that there are agents among us, That shotgun or carbine in the corner can no longer be used as decoration, or as an item to impress a sister of your heroism it is now a death warrant, whether you use {it or not, If you don’t use it, these hand-picked, foaming- mouthed, wild-tyed assassins of CCS and SWAT will place it In your hands, after you are DEAD. Who are these hand-picked maniacs, so reminiscent of Hit- ler’s Gestapo and SS Corps? They are groups of dedicated, mad ra- cists who are not playing. The rhetoric about not expecting justice or mercy from the racist enemy Is how concrete reality. They are trained to kill and are efficient with it. TAC Is ostensibly special tac- tical squads, organized, trained and equipped to try and deal with any explosive situation amongst the people quickly and in deadly style, while the buffoons in the Black and White patrol cars continue their dispersed patrols in all parts ofthe city, so as to avoid concentration of troops in one area and thinning out in others. METRO or vice squad may be somehow intimately linked with TACK squads or under the same department. They are known for raids, In and out of uniform they ride in unmarked cars, and have been known to ride in row trucks to TAXI CABS. CCS (Criminal Conspiracy Sec- tlon) are the slinking snakes who are masters of the frame-up, These lunatics sneak about the city trying to persecute brothers for merely organizing among the people or for associating with one another, After any type of political activity in the city, you can be certain that these dogs are out trying to create con- splracy charges against those who work the hardest, SIS or SIU ts a group of slap- happy, cracker-jack sples and In- formers, The noise on your phone or the television-type detective, reading the newspaper in the car across the street from your house, is very likely from this group. From information available, their jobs seem to be Infiltration and surveillance of the Movement. They cooperate closely with the FBI, CIA, and the intelligence groups from other city police departments. Files are kept of all known polit- ical activists. We also tend to be- eve that these cloak and dagger fiends constitute the nerve center of the purely anti-Movement arm of the pig forces, If tomorrow morning you hear a loud bang at your door, and as it flies open, NMghts hit you and a voice shouts, ‘Don't move nigger’', and you open your eyes to behold wild-looking, glassy-eyed maniacs standing above your bed holding evey type of weapon mentionable, you can be sure that the stuff has hit the fan! The prosecution was done by Michael Torrence of the San Jose State BSU. The inquest was pre- sided over by Bill Calhoun, Chair- man of the BSU of San Jose City. A crowd of about 500 college stu- dents, high school students, and members of the community, were present in the interest of justice, to hear the people's side, and bring about an indictment against pig Jarrott, for murder in the first degree. The newspaper report of the in- cident, whichoccurredon March 31, at 12 p.m., conflicts considerably with the investigations of the People, and the coroner's report. According to the media, Donald Miller and one or moreaccomplices, armed with a 22, attempted to rob the Jack-in-the-Box located at the corner of E] Camino and Lafayette, in the city of Santa Clara. Pig Jarrott, responding to a call al- legedly given by some unkown off- duty pig, arrived on the scene as Donald Miller and the other brother jumped a fence located at the rear of the Jack-in-the-Box, and were running across the parking lot. Jar- rot, the paper says, shouted ‘‘halt’’ several times, fired awarning shot, and then shot. and killed Donald Miller. The other person involved escaped and is stillatlarge. Accord- ing to the paper Donald Miller was shot in the back, and here is the first contradiction, The coroner's report says Donald Miller was shot in the chest. How can you be run- ing away and get shot In the chest? After speeches from the BSU, and the Revolutionary Action Movement, the prosecution first called upon John Keltch, a member of the Social- ist Worker's Party to give some first hand background on pig Jarrott's activities as a strike-breaker atthe Pittsburgh-Demoines Stee] Plant in Santa Clara. Even then Jarrott had shown himself to be exceptional at brutalizing the people, The prosecution then read a Teport by the attendant at the Jack- in-the-Box, who was possibly the only eyewltness to the entire in- cident. His story contradicts the pig's story very obviously, He stated that at no time was Donald Miller armed. The alleged .22 was held by the other person. Donald and the second brother ran through the kitchen and out of the back door, They jumped the fence and ran off across the parking lot of the adjoining bar. Pig Jarrott ran around back, and the attendant is very clear on the point that only one shot was fired, and Donald Mil- ler was dead, A preliminary investigation by the local NAACP shows that on a police diagram the .22 was outlined on the pig's side of the fence where the brothers obviously dropped the Statement For Release To The Black Press April 6, 1970 During the early morning hours of April 1, one or more terror- ists operating under the cover of night and taking advantage of a cam- pus relatively vacant because of spring recess, did apparently plan and, in fact, effectively execute an arson attack against the Africana Studies and Research Center at 320 Wait Avenue, Ithaca, New York. Arson experts have concluded that the fire was not electrical or started by a cigarette. The material used to start the fire was highly flammable and it was started in more than one place. Apparently the person or persons Involved had ample time to look over the whole building and choose the most stra- tegic places to start the blaze. The total destruction of the building points to this being a professional job. The Black community of Ithaca has consistently been viciously at- tacked In all aspects of our lives as has been demonstrated by the burning of the Southside Community Center, brutalization and neglect of Black children in the Ithaca Public School System, as well as the re- peated attempts on the lives of the Black women living at Wari House, The clear fact is that this incident reflects historical truism in America--that it has been in the White community that law andorder has never been respected, It has been Inthe White community that the breakdown of law and order has been most criminal and, of course, most damaging to both life and property of Black people. We see oppression in the form of the political assass- {nationsof Martin Luther King,Fred Hampton and Ralph Featherstone; constant harassment of Black ical organizations--the Black Pan- ther Party, incarcerations and/or forced exiles of Black leaders and recent repressive legislation such as the Supreme Court decision re- garding unruly defendents and the closing of the Black Studies at San Francisco State College. The consensus ofthe entire Black community at Cornell reflects that of the larger Black community around this country, that their per- sons and their property are inse- cure and are threatened in this at- mosphere, Dale Corson, President of Cornell University, rejected the following proposals: 1, Security for residences, for Black people by Black person- nel; 2. We want an end to the robbery by the CAPITALIST of our Black Community We believe that this racist government has robbed us and now we are demanding the overdue debt of forty acres and two mules. Forty acres and two mules was promised 100 years ago as restitution for slave labor and mass murder of black people. We will accept the payment in currency which will be distributed to our many communities. The Germans are now aiding the Jews in Israel for the genocide of the Jewish people. The Ger- mans murdered six million Jews. The American racist has taken part in the slaughter of over fifty million black people; therefore, we feel that this is a modest demand that we make. 4. We want decent housing, fit for shelter of human beings. We believe that if the white landlords will not give decent housing to our black community, then the housing and the land should be made intc cooperatives so that our community, with government aid, can build and make decent housing for its people. 5. We want education for our people that exposes the true nature of this decadent American society. We want education that teaches us our true history and our role in the present-day society. We believe in an educational system that will give to our people a knowl- edge of self. If a man does not have knowledge of himself and his position in society and the world, then he has little chance.to relate to anything else. 6. We want all black men to be exempt from military service. We believe that Black people. should not be forced to fight in the mifi- tary service to defend a racist government that does not protect us. We will not fight and kill other people of color in the world who, like black people, are being victimized by the white racist government of America. We will protect ourselves from the force and violence of the racist police and the racist military, by whatever means necessary. 7. We want an immediate end to POLICE BRUTALITY and MURDER of black people. We believe we can end police brutality in our black community by or- ganizing black self-defense groups that are dedicated to defending our black community from racist police oppression and brutality. The Second Amendment to the Constitution of the United States gives a right to bear arms. We therefore believe that all black people should arm themselves for self-defense. 8. We want freedom for all black men held in federal, state, county and city prisons and jails, We believe that all black people should be released from the many jails and prisons because thoy have not received a fair and impartial trial. 9. We want all black people when brought to trial to be tried in court by a jury of their peer group or people from their black communities, as defined by the Constitution of the United States. We believe that the courts should follow the United States Constitution 30 that black people will receive fair trials. The 14th Amendment of the U.S. Constitution gives a man a right to be tried by his peer group. A peer is a person from a similar economic, social, religious, geographical, en- vironmental, historical and racial background. To do this the court will be forced to select a jury from the black community from which the black defendant came. We have been, and are being tried by all-white juries that have no understanding of the “average reasoning nian’ of the black community 10. We want land, bread, housing, education, clothing, justice and peace. And as our major political objective, a United Nations-supervised plebis- cite to be held throughout the black colony in which only black colonial subjects will be allowed to participate, for the purpose of determining the will of black people as to their national destiny. When, in the course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume, among the powers of the earth, the separate and equal station to which the laws of nature and naturg’s God entitle them, a decent respect to the opinions’of mankind requires that they should declare the causes which impel them to the separation. We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these are life, liberty, and the pursuit of happiness. That, to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed; that, whenever any form of government becomes destructive of these ends, it is the right of the people to alter or to abolish it, and to institute a new government, laying its foundation on such principles, and organizing its powers in such form, as to them shall scem most likely to effect their safety and happiness. Pru- dence. indeed, will dictate that governments long established should not be changed for light and transient causes; and, accordingly, all experience hath shown, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed.
